Alaska Community Property Agreement Mortgage

An Alaska community property agreement mortgage file is a house loan where the spouses have opted into community property under Alaska’s statute, and that choice changes who owns the property and how a lender reads the household. Alaska does not start there. Most married couples in the state hold property under ordinary title rules unless they sign an agreement or create a community property trust. AS 34.77.030(a) says property of spouses is community property under that chapter only to the extent a community property agreement or a community property trust provides. AS 34.77.030(c) gives a spouse a present undivided one-half interest in community property. The one-half interest applies to property that actually is community property under the agreement, not to every asset a married person in Alaska owns.

People closing on Anchorage homes sometimes arrive with an agreement they signed years ago for estate planning and forgot to mention. Title finds it, or should. The loan has to match it. Alaska Home HQ is educational. It is not a law firm and it is not a lender.

How an Alaska community property agreement mortgage file starts

AS 34.77.090 says a community property agreement is a written document signed by both spouses that classifies some or all of their property as community property, and that it must open with a conspicuous capital-letter warning about how broad the consequences can be, including creditors and divorce. Both signatures matter. A letter one spouse wrote is not the agreement. An agreement signed before marriage can exist, and the statute says it does not become effective until the people are married.

The agreement can classify property acquired during the marriage, and it can reach further if the spouses expressly say so. Property owned before the agreement is not community property unless the document says it is. Income earned after the determination date can be community property when the agreement says all property acquired during the marriage is community property. Those are statute-shaped sentences. The PDF you signed is the one the lender needs, because couples do not all choose the same options.

Bring the recorded copy if it was recorded, and the signed copy if it was not. Ask title whether it has to be recorded to affect the house you are buying. Do not assume a filing in a different state, or a Washington-style presumption, applies because you used to live there. If you want Alaska rules, you are in AS 34.77. If you are still bound by another state’s regime, say so at the start. That is a lawyer’s question and a title question.

How you take title on the deed is a related choice. Joint tenancy and tenants in common are explained in the joint tenancy guide. A community property agreement is not a substitute for reading that vesting. It can sit beside it. Draw the picture: whose names are on the deed, what the agreement says those names mean, and who will sign the note.

What the lender and the title company do with the agreement

Title wants to know whose signatures release the property and whose interest the deed of trust has to reach. If both spouses own a one-half community interest, both generally have to sign the security instrument so the lien covers the whole. Who signs the note is a credit decision. A spouse can be on title and on the deed of trust and still be a non-borrowing spouse if they do not sign the note. The agreement does not force them onto the debt. It does make their ownership real.

Debts are the other half of the surprise. In states where community property is the default, lenders often include the non-borrowing spouse’s debts in the ratio because those debts can reach community assets. Alaska is opt-in. If you have opted in, ask the lender, with the agreement in hand, whether this shop will count the other spouse’s debts. If you have not opted in, do not let a generic “community property state” checklist treat you like a Washington or California couple. Hand them AS 34.77 and the fact that you have no agreement, if that is the fact.

A divorce later unravels these choices under the agreement and under divorce law. The divorce mortgage buyout page is the refinance side of a split. An agreement that says property passes a certain way at death does not, by itself, remove a deed of trust. The lien stays until it is paid or refinanced. Read the agreement’s death language with an estate attorney. Read the payoff with the lender.

What to tell the loan officer on the first call

Say whether an agreement exists, whether a trust exists, and whether either document classifies the house or the earnings. Offer the PDF the same day. If you are about to sign an agreement so that a house purchase “looks cleaner,” stop and talk to a lawyer first. The statutory warning exists because the consequences are wide. A mortgage timeline is a poor moment to invent an estate plan.

Earnings that become community property under the agreement are still documented as income in the usual way: paystubs, returns, awards. The agreement does not create qualifying income. It classifies property. A spouse’s cannabis wages, seasonal overtime, or a pension still follow the rules for that kind of income. The agreement may change who owns the savings. It does not change a program’s ban or its history requirement.

A Permanent Fund Dividend can be community or separate depending on what the agreement says about after-acquired property and income. If you will use a dividend for cash to close, show the deposit and show the agreement if one exists so the source and the owner match.

A short checklist

  • The signed agreement, and the recording information if it was recorded
  • A sentence on what it classifies: all marital acquisitions, or only named assets
  • Both spouses’ names as they appear on the agreement and on their IDs
  • Any community property trust, if that is the tool you used instead
  • A clear answer on who will sign the note and who will sign only the deed of trust

Rates vary. Subject to credit approval. The agreement is a title and debt fact. It is not a rate discount and it is not a penalty. It is a document that has to match the deed.

Frequently Asked Questions

Is Alaska a community property state by default?

Not in the way Washington or California is. AS 34.77.030(a) makes property community property only to the extent a community property agreement or a community property trust provides. Couples who have never signed one are not automatically splitting a present one-half interest under that chapter. If you did sign one, the one-half interest in AS 34.77.030(c) applies to the property the agreement actually classifies.

Do both spouses have to sign the mortgage if we have an agreement?

They often both sign the deed of trust so the lien reaches both halves of community property. Signing the deed of trust is not the same as signing the note. A spouse can secure the house and still not be the borrower. Ask title and the lender to say which signature block is which, and do not leave a vested owner off the security instrument and hope the lien is complete.

Will my spouse’s debts count against my loan if we opted in?

Ask the lender with the agreement in front of them. Opting in can cause a shop to treat spouse debts the way community-property files are treated, because creditors and ownership changed when you signed. If you have no agreement, say that clearly so a generic checklist does not add debts the statute has not classified. Subject to credit approval either way.

Can we sign a community property agreement just to help a mortgage close?

You can sign one only if you want the legal consequences, which AS 34.77.090 tells you are broad, including creditors and divorce. A closing calendar is a weak reason to reclassify your property. Talk to a lawyer about whether you need the agreement at all. Many Alaska loans close with ordinary joint tenancy or sole ownership and no community property agreement.

Does the agreement replace a will or a transfer on death deed?

It can include nontestamentary transfer language if the statute’s options are used, and that is estate planning, not a mortgage form. A lender financing the house today cares who owns it now and who will sign. What happens at death is a second reading for an estate attorney. Do not use a mortgage article as the estate plan.
